Welcome to Psage. These Terms of Service ("Terms") form a binding agreement between you ("User", "you", or "your") and Psage ("Psage", "we", "us", or "our"). By accessing or using psage.app, api.psage.app, or any related service (collectively, the "Service"), you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
1. Description of Service
Psage is a Software-as-a-Service (SaaS) platform that generates short-form product video advertisements using AI and motion design. Users provide product information (typically via a product URL from Shopify or a similar e-commerce platform, or by manual upload), and the Service automatically generates a video file suitable for platforms such as TikTok, Instagram Reels, YouTube Shorts, and similar.
Psage renders videos server-side using Remotion and other proprietary pipelines. Generated videos are stored temporarily in our cloud storage and made available to the User for download and use.
1.1 Beta and Experimental Features
Some features of the Service may be provided as beta, experimental, or early-access features. Such features may be changed, limited, suspended, or discontinued at any time and may not always function as expected. This includes, without limitation, product URL parsing, template selection, rendering behavior, AI-generated hooks or captions, and third-party publishing integrations where available.
Where publishing integrations are available, you are solely responsible for connecting authorized accounts and ensuring that any published content complies with the rules, policies, and technical requirements of the relevant third-party platform.
1.2 AI-Powered Service Disclosure
Psage is an AI-powered service. The video output and accompanying marketing copy, captions, and voiceover audio are generated using artificial intelligence and machine learning models, including third-party models accessed via API. By using the Service, the User acknowledges that they are interacting with an AI system within the meaning of Article 50(1) of Regulation (EU) 2024/1689 (the "EU AI Act") and analogous regulations.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By using the Service you represent and warrant that you meet these requirements.
If you use the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
3. Account Registration
To access most features of the Service, you must create an account. You may register using an email address and password, or by signing in with a supported third-party provider (currently Google).
You are responsible for:
- Providing accurate, current, and complete information during registration;
- Maintaining the confidentiality of your password and account credentials;
- All activity that occurs under your account;
- Notifying us promptly of any unauthorized access to your account.
We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used in a manner that harms the Service or other users.
4. Subscription Plans and Billing
4.1 Plans
Psage offers the following plans:
- Free β a limited introductory plan with a one-time allowance of generated videos and a Psage watermark on all exports;
- Pro β a paid monthly subscription with a defined monthly video quota and no watermark;
- Business β a paid monthly subscription for teams and agencies, with an expanded video quota and additional team features.
Current pricing, quotas, and included features are published on psage.app/pricing and may be updated from time to time.
4.2 Payment Processor
All paid subscriptions are processed by an authorized third-party payment processor, which acts as the Merchant of Record for purchases made through Psage. The payment processor is responsible for processing payments, handling sales taxes and VAT where applicable, and issuing invoices.
By purchasing a paid plan or add-on, you also agree to the applicable checkout, payment, and refund terms presented by the payment processor at the time of purchase.
4.3 Billing Cycle and Renewal
Paid subscriptions are billed in advance on a recurring monthly basis (or annual basis, where offered) and automatically renew at the end of each billing period unless cancelled.
4.4 Cancellation
You may cancel your subscription at any time from your account dashboard or by contacting support. Upon cancellation, you will retain access to paid features until the end of the current billing period. No partial refunds are issued for unused time within a billing period, except as described in our Refund Policy.
4.5 Price Changes
We may change subscription prices at any time. If a price change affects an active paid subscription, we will notify you in advance via email or in-product notification at least 14 days before the change takes effect. Continued use of the Service after a price change constitutes acceptance of the new price.
4.6 Usage Quotas
Each plan includes a maximum number of generated videos per billing period ("Quota"). Unused Quota does not roll over to subsequent periods. Attempts to exceed the Quota will be blocked until the next billing period, or until the User upgrades their plan or purchases additional add-ons where available.
5. Acceptable Use
You agree not to use the Service to:
- Create, generate, or distribute content that is illegal, infringes third-party rights, or violates the terms of any platform on which you intend to publish the generated videos;
- Generate videos depicting, promoting, or facilitating violence, hate speech, child sexual abuse material, non-consensual intimate content, or content sexualizing minors;
- Impersonate any person or entity, including by misrepresenting ownership of a product or brand you do not own or have rights to advertise;
- Submit product URLs or images containing malware, exploits, or content designed to compromise the Service or other users;
- Attempt to reverse engineer, decompile, scrape, or otherwise extract the underlying source code, templates, or proprietary rendering logic of the Service;
- Use automated means (bots, scrapers, crawlers) to access the Service beyond publicly documented APIs;
- Resell, sublicense, or white-label the Service without an explicit written agreement with us (note: Business plan team features are for internal team use, not for reselling raw Psage access to third parties);
- Generate, distribute, or publish misleading, deceptive, defamatory, or otherwise unlawful content;
- Generate AI content that depicts identifiable real persons in a manner intended to deceive viewers, including deepfakes, face swaps, or manipulated likeness, without the documented authorization of the person depicted;
- Clone, synthesize, or otherwise replicate the voice or vocal likeness of an identifiable real person without that person's documented authorization;
- Use the Service to develop, deploy, or generate content for any High-Risk AI System use case as defined under Annex III of Regulation (EU) 2024/1689 (the "EU AI Act") or under any analogous regulation applicable to you, including biometric identification or categorisation, social scoring, predictive policing, employment or worker management decisions, education or vocational training decisions, credit scoring or loan assessment, law enforcement, migration or border control, administration of justice, or operation of critical infrastructure;
- Use the Service in any manner that violates applicable artificial intelligence regulations, including the EU AI Act, or that would cause Psage to be in breach of its own obligations under such regulations.
We may reject, block, remove, or refuse to generate or publish any User Content or Generated Video if we reasonably believe it violates these Terms, applicable law, third-party rights, or platform policies.
Violation of this Acceptable Use policy may result in immediate suspension or termination of your account without refund.
6. User Content and License
6.1 Your Content
"User Content" means any product data, images, text, URLs, uploads, or other material you submit to the Service for the purpose of generating videos.
You retain all ownership rights in your User Content. You represent and warrant that:
- You own or have the necessary rights and permissions to use and submit the User Content;
- The User Content does not infringe third-party rights, including intellectual property, privacy, or publicity rights.
For business users, merchants, and users acting on behalf of a company, brand, or other legal entity, the Merchant warrants that they own or have all necessary rights to use the product information, product imagery, trademarks, and any other content submitted to Psage. The Merchant shall indemnify and hold Psage harmless from any third-party claim arising from the Merchant's submitted content or use of the generated output.
6.2 License to Us
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and use the User Content solely as necessary to provide the Service to you, including generating videos, storing them temporarily in our cloud storage, and making them available for your download.
We do not use your User Content to train AI models, and we do not sell, license, or publicly display your User Content for any purpose other than providing the Service to you.
6.3 Generated Videos
Videos generated by the Service from your User Content ("Generated Videos") are yours to use, publish, and modify under the following conditions:
- Free plan Generated Videos include a Psage watermark and must retain that watermark when published;
- Paid plan Generated Videos are watermark-free and may be used for any lawful purpose, including commercial advertising on TikTok, Instagram, YouTube, Meta, and similar platforms.
Psage retains ownership of the underlying templates, motion design, pipeline, and code. You may not extract, redistribute, or resell template assets as standalone products.
6.4 AI-Generated Nature of Output
Generated Videos are produced using AI and motion design. Where required by applicable law, including Article 50 of the EU AI Act or analogous local regulation governing the labelling and disclosure of AI-generated content, the User is responsible for disclosing to end consumers and viewers that the Generated Videos are AI-generated or AI-assisted. Psage may additionally embed machine-readable indicators of AI-generated content in the Generated Video files in accordance with Article 50(2) of the EU AI Act.
6.5 Music and Platform Audio
Music is not bundled by default with Generated Videos unless expressly stated in the Service. Users are responsible for adding platform-approved music after download, for example through TikTok, Instagram, YouTube Shorts, or another platform-approved or commercially licensed music source. If you add music, sound effects, or other audio to a Generated Video outside Psage, you are solely responsible for ensuring that you have the necessary rights, licenses, and platform permissions for that audio. Psage is not responsible for third-party audio selected or added by the User after download.
7. Storage and Deletion
Generated Videos and associated source assets are stored in our cloud storage for a period of up to 90 days from the date of generation, after which they may be automatically deleted. You are responsible for downloading and backing up Generated Videos you wish to retain.
You may delete your account at any time by contacting support. Upon account deletion, we will delete or anonymize your personal data within 30 days, subject to legal retention obligations. See our Privacy Policy for details.
8. Third-Party Services
The Service integrates with and relies on third-party services, including but not limited to:
- Supabase (database and file storage);
- Google Cloud (text-to-speech, OAuth authentication);
- OpenAI (text generation for hooks, captions, and scripts);
- Authorized payment processor (payment processing, subscriptions, tax/VAT handling, and Merchant of Record);
- Vercel (frontend hosting);
- EU-based VPS provider (backend infrastructure).
We are not responsible for the availability, performance, or terms of use of third-party services. Your use of these services through Psage is subject to the respective third parties' terms and privacy policies.
9. Intellectual Property
All rights, title, and interest in the Service, including its software, templates, design, trademarks, logos, and documentation, are and remain the exclusive property of Psage. Nothing in these Terms transfers any intellectual property rights to you, other than the limited license to use the Service as described.
10. Service Availability and Modifications
We aim to provide the Service with reasonable availability but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis.
We may, at our sole discretion, modify, suspend, or discontinue any part of the Service at any time, with or without notice. If a discontinuation materially affects active paid subscriptions, we will provide reasonable advance notice and, where applicable, prorated refunds for unused prepaid time.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that Generated Videos will achieve any specific marketing, commercial, or performance result, nor that Generated Videos will comply with the advertising policies of any third-party platform (TikTok, Instagram, Meta, YouTube, etc.). You are solely responsible for verifying compliance before publication.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Psage from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of:
- Your User Content;
- Your violation of these Terms;
- Your violation of any third-party rights, including intellectual property or privacy rights;
- Your use of Generated Videos on any third-party platform.
14. Termination
We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms, for prolonged inactivity, or for any other reason we deem necessary to protect the Service and its users. Upon termination:
- Your access to the Service will end;
- Any remaining Quota or prepaid time will be forfeited, except as provided in the Refund Policy;
- Sections of these Terms that by their nature should survive termination (including Sections 6, 9, 11, 12, 13, 16, 17) will remain in effect.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on psage.app/terms with a new "Last Updated" date. Material changes will be communicated via email or in-product notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of Ukraine. Any dispute arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Odesa, Ukraine, unless a different forum is required by applicable consumer protection law in your jurisdiction.
17. AI and Regulatory Compliance
Psage uses AI and machine learning technologies to generate video content. The Service is intended for lawful e-commerce marketing and advertising purposes only.
17.1 Scope
Based on its current functionality, Psage is not designed or intended to be used as a High-Risk AI System under Annex III of Regulation (EU) 2024/1689 (the "EU AI Act"). The Service does not perform biometric identification or categorisation, emotion recognition, social scoring, predictive policing, employment, education, credit or loan assessment, law enforcement, migration, justice, or critical infrastructure decisioning.
17.2 Transparency
In line with Article 50 of the EU AI Act:
- Users are informed at signup and within the Service interface that they are interacting with an AI-powered system, in line with Article 50(1);
- Generated Videos may be marked as artificially generated content in a machine-readable format so that the synthetic nature of the output can be detected, in line with Article 50(2);
- Where Generated Videos may fall within the definition of "deep fake" under Article 3(60) of the EU AI Act, the User remains responsible for any additional disclosure required by the platforms or jurisdictions in which the Generated Videos are published, as described in Section 6.4.
17.3 User Obligations
Users are responsible for ensuring that their own use of the Service and of Generated Videos complies with applicable AI, advertising, consumer protection, and intellectual property laws in their jurisdiction. Where the User is itself an AI provider or deployer under the EU AI Act or analogous regulation, the User remains responsible for its own compliance obligations.
17.4 Changes to Functionality and Prohibited Use
If the User's intended use of the Service appears to fall outside the scope described above, including any High-Risk AI System use case, the User must stop such use immediately and contact Psage at support@psage.app. Psage reserves the right to suspend or terminate accounts that use the Service for prohibited or High-Risk AI purposes.
